A woman in the UAE is taking action against her husband for two years of withdrawal of financial support. She went out of her house because of this and is using legal means for him to provide it. According to Article 124 of the Personal Status Law in the UAE, abstaining from support by a husband presents a valid case for a wife to ask for a divorce.
Article 124 declares that if the husband desists from providing alimony to the wife without there being any visible wealth to pay such alimony, the wife is allowed to claim separation. When the husband falsely declares bankruptcy with no evidence presented, the judge can immediately decide on divorce. The wife may be granted alimony for three years from the case’s date of filing. Yet, she needs to present herself to her husband without any valid excuse according to Sharia law.
The woman is advised to go back to her home and file a case to ensure that her rights are protected. This case emphasizes the need to understand and utilize legal provisions to address personal and family issues in the UAE.
