Unfair Dismissal in the UAE: Know Your Rights & How to File a Complaint

Unfair dismissal is still a major issue for employees in the UAE, with numerous workers being fired under conditions that might infringe on UAE Labour Law. In case an employee is discharged due to submitting a labour complaint, it might be qualified as arbitrary dismissal, which would make them eligible for legal action and compensation.

The UAE Labour Law safeguards workers against unjust dismissal without proper reason. If an employer dismisses an employee without a valid reason or in retaliation for the exercise of their legal rights, the termination can be contested in court. Arbitrary dismissal compensation can reach up to three months’ salary, depending on the case.

Workers who feel they have been unjustifiably terminated can submit a labour complaint to the Ministry of Human Resources and Emiratisation (MOHRE) or the free zone authority that regulates their workplace. The procedure is usually through mediation, and if it cannot be settled, the case is referred to the Labour Court for a final ruling.

Employees are urged to record all communications concerning employment and consult with an attorney when needed. Familiarity with your rights and the legal process can aid in protection against wrongful termination and fair treatment at work.
