UAE Sees Surge in US Immigration Applications Amid Trump’s Possible Return

With President-elect Donald Trump returning to the White House in January, concerns about stricter immigration policies have surged. Calls to a top US immigration firm in Dubai have noticeably increased as families, students, and professionals scramble for clarity amidst the uncertainty.

“There’s a wave of concern gripping immigrants both in the US and abroad,” said Shai Zamanian, legal director of The American Legal Center. Trump’s campaign pledges to end birthright citizenship, terminate the diversity lottery, tighten restrictions on H-1B and family-based visas, and enforce mass deportations have heightened the urgency among those considering migration to the US.

“These policies are creating a sense of urgency,” Zamanian said. He also noted that during Trump’s first term, the H-1B visa program faced significant restrictions, with the administration citing its potential impact on US jobs and wages.

The H-1B visa is a temporary (non-immigrant) category that allows employers to hire highly skilled foreign professionals for specialized roles in technology, engineering, medicine, and other industries. Initially issued for three years, the visa can be extended for a maximum of six years.

However, some UAE residents expressed concerns even before the US elections. Many fear they could lose their opportunity to migrate.

“There’s so much uncertainty surrounding US immigration policies,” said Reem (name changed), a Dubai resident. “I’m worried about what might happen next. Policies could change drastically under Trump’s leadership, given his strong anti-immigration stance.”

EB-5 Program: A Secure Alternative

Despite the apprehension, Zamanian highlighted the EB-5 Immigrant Investor Program as a stable and viable route to US residency. The EB-5, established in 1990, allows foreign investors to gain Green Cards by investing $800,000 in government-approved, job-creating projects. The program remained resilient during Trump’s previous term, providing a pathway for families, students, and professionals seeking secure residency options.

“Trump himself is familiar with the EB-5 program and its benefits,” Zamanian explained. “In fact, his companies utilized EB-5 funds to complete significant projects, such as the Trump Bay Street development in Jersey City, New Jersey. As a businessman, he recognizes the importance of foreign investment in driving economic growth and creating jobs.”

Critical Time to Act

Zamanian emphasized that the months leading up to Trump’s inauguration offer a limited window for those considering the EB-5 program. He noted that legal immigration pathways are expected to narrow further during Trump’s presidency.

“Families with children studying in the US on F-1 visas, as well as professionals holding H-1Bs, are looking to upgrade to Green Cards through the EB-5 program. This is their chance to avoid the uncertainty surrounding other visa categories,” he said.

The Benefits of EB-5

The EB-5 program provides a direct path to US residency. Successful applicants and their immediate family members receive Green Cards, allowing them to live, work, and travel freely in the United States. Zamanian pointed out that concurrent filing options enable applicants to start enjoying Green Card benefits almost immediately.

“This short window to act is critical,” Zamanian said, adding that he anticipates a surge in EB-5 applications in the coming months.

Trump’s Potential Impact on Immigration Policies

Trump has consistently emphasized his plans to impose stricter immigration measures. During his campaign, he reiterated his intention to ramp up border restrictions, reinstate the “Remain in Mexico” program terminated by President Biden, and enforce large-scale deportations.

“In addition to these measures, industry experts anticipate tougher legal migration policies under another Trump administration,” Zamanian explained.

Despite these challenges, Zamanian remains optimistic about the EB-5 program’s resilience. He believes Trump’s familiarity with the program and his recognition of its economic benefits will help preserve it.

“For those seeking stability amidst a shifting immigration landscape, the EB-5 program is one of the most reliable options,” Zamanian said.

A Secure Future with EB-5

The US Congress established the EB-5 program in 1990 to boost the economy through job creation and foreign investment. Administered by USCIS (United States Citizenship and Immigration Services), the program allows investors to secure US residency by investing in pre-approved projects that create jobs.

Zamanian reassured that the EB-5 program has stood the test of time. He added that families and professionals exploring this route are choosing a secure and stable path to residency in the US, regardless of potential policy changes under Trump or future presidents.

“As policies evolve, the EB-5 program remains a safeguard for those seeking a secure pathway to the US,” Zamanian concluded.
