UAE: What is Compassionate Leave and When Are You Eligible?

Compassionate leave, often known as bereavement leave, is a provision in the UAE’s Labour Law that allows employees to take time off following the death of a family member. This leave is intended to provide employees with the necessary time to grieve and handle personal matters during such challenging periods.

Eligibility for Compassionate Leave
In the UAE, compassionate leave is typically granted to employees who face the death of an immediate family member. This includes parents, spouses, children, siblings, and, in some cases, grandparents or in-laws.

Mainland Companies:
According to the UAE Labour Law, employees working for mainland companies are entitled to 3 days of paid leave upon the death of an immediate family member. This leave is applicable regardless of the type of contract the employee holds and is usually granted without the need for documentation beyond the death certificate.

Free Zone Companies:
The regulations for compassionate leave may vary for employees in free zones. Each free zone has its own rules, which might provide different lengths of leave or specific conditions. Some free zones may offer longer leave periods, while others might follow the standard days set by mainland regulations. Employees should review their employment contracts or the specific labour regulations of their free zone for accurate information.

Conditions and Requirements
Employees must promptly notify their employer about the death of a family member.
The leave is generally paid, although some companies may ask for documentation, such as a death certificate or proof of relationship.
The duration of leave may differ for family members not considered immediate family (e.g., in-laws), and some employers might provide additional days based on their company policies.
Conclusion
Compassionate leave is an essential aspect of the UAE’s Labour Law, granting employees vital time to deal with family emergencies like the loss of a loved one. It is crucial to understand the details, particularly regarding free zone companies, to ensure proper compliance and support during these difficult times.
