Saudi Arabia: Labour Transfer Rules for Suspended Workers Clarified

Saudi labour authorities have made it clear that workers who are under suspension cannot change their employment until their situation is resolved. This statement was issued by the Saudi Ministry of Human Resources in response to an inquiry from an employer regarding the transfer of a suspended worker to a different establishment.

The ministry explained:

“A worker whose status is suspended from work cannot have their service transferred. To change the worker’s status, approval from the current employer is required.”

Protecting Contractual Rights
This directive is part of Saudi Arabia’s larger efforts to protect labour rights. Earlier this year, the government introduced significant labour reforms aimed at ensuring fair contractual practices for its substantial expatriate workforce.

Implications for Employers and Workers
Employers are required to resolve any suspension-related issues internally before considering transfers. This approach promotes transparency and ensures that workers’ statuses are appropriately managed before they seek new employment opportunities.

For expatriates and businesses operating in Saudi Arabia, these regulations highlight the necessity of following contractual and procedural requirements in employment matters.
