UAE: Guidelines for Transferring Domestic Workers and Legal Job Resignation

The UAE Ministry of Human Resources and Emiratisation (MOHRE) has established clear guidelines for domestic workers. These guidelines are about their transfer to new employers and the process for legally resigning from their current jobs. These rules are designed to protect the rights of both employers and employees while ensuring adherence to labor laws.

Domestic workers are permitted to transfer to a new employer if their current contract has expired or if both the worker and employer agree to terminate the employment. Transfers are also allowed in situations where the employer does not fulfill legal obligations, such as failing to pay wages or providing inadequate working conditions. These measures help domestic workers pursue better opportunities while ensuring their job security.

MOHRE has also specified circumstances under which a domestic worker can resign without facing penalties. This includes situations involving abuse, unsafe working conditions, or breaches of the contract by the employer. Workers are encouraged to report these incidents through official channels to receive appropriate legal protection and resolution.

Both employers and domestic workers are encouraged to follow the ministry’s guidelines to promote fair treatment and mutual respect. These regulations demonstrate the UAE’s dedication to protecting the rights of all workers and fostering ethical employment practices across various sectors.
