In a twist of fate, the Fujairah Court of Appeals reversed jail terms issued to four men involved in a reckless car chase across the emirate. Rather than prison terms, the court gave them a joint fine of Dh18,000, considering the intricate circumstances surrounding the case. The ruling was the subject of debate regarding judicial flexibility in meeting justice with mercy.
The case started when the authorities tried to apprehend the men for dangerous driving, which led to a perilous pursuit that covered several miles. In an initial ruling, a lower court sentenced the four defendants to different prison terms for jeopardizing public safety. In the appeal stage, lawyers representing the defense claimed that the men were acting under duress and had no ill will towards causing harm to anyone.
The appellate court recognized the gravity of the crime but also took into consideration the defendants’ clean records and personal lives. Citing the need to secure public safety, the court nevertheless imposed financial punishment to hold them accountable, with a warning that repeat offenses would merit increased punishment.
This incident shows the UAE’s strong but balanced attitude towards law enforcement, where public security is always the priority, but individual situations are meticulously considered. It also reminds drivers of the dire consequences of irresponsible driving on the roads, even when prison sentences can occasionally be evaded.
